Re-collation: Supreme Court Dismisses Objection to NDC’s Application

The Supreme Court has rejected a preliminary objection raised against the National Democratic Congress’s (NDC) certiorari application aimed at overturning a High Court ruling. The ruling in question ordered the re-collation of parliamentary election results in six constituencies.

On Friday, December 27, Gary Nimako Marfo, legal counsel for the New Patriotic Party (NPP) parliamentary candidates in the disputed constituencies, argued that the NDC had failed to include the High Court’s judgment when filing its application. According to him, this omission violated court procedural rules and warranted the dismissal of the application.

However, the five-member Supreme Court panel ruled otherwise, stating that although the NDC initially failed to attach the High Court’s decision, the judgment was later submitted through a supplementary affidavit. Consequently, the court chose to overlook the procedural lapse and proceeded to hear the application.

The panel, presided over by Justice Gabriel Pwamang, included Justices Henrietta Mensa-Bonsu, Eric Gaewu, Henry Kwofie, and Richard Adjei-Frimpong.

Following arguments from the NDC’s lawyer, Godwin Edudzi Tameklo, Electoral Commission lawyer Justine Amenuvor, and NPP counsel Gary Nimako Marfo, the court retired to deliberate on the matter and deliver its ruling.
